URKABE BENETAN, SA, hereinafter BENETAN, in accordance with the legal requirements imposed by Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, is recognised as personal data Controller and undertakes to treat it in accordance with the regulatory requirements and the risks associated with its treatment, which have previously been identified. By the mere fact of visiting this Portal there is no processing of personal data since no personal data that identifies the User is automatically registered.

In order to guarantee the proper management of personal data, all BENETAN employees who intervene in the processing of data are aware of the data protection policies established by the entity, thus ensuring the confidentiality, integrity, availability, and resilience of personal data as well as the ability to effectively restore personal data as soon as possible in the event of an incident.

Purpose and duration of the processing of your personal data
Each time BENETAN requests the User’s personal data, he / she will be expressly informed, at the time of data collection, of the purpose of the processing for which he / she is to give his / her consent. The duration of the processing of personal data will, in general, be indefinite unless expressly indicated otherwise by BENETAN, or the User exercises his / her right of deletion, at which time we will delete the personal data except for those data that we are legally obliged to keep for the time established.

Legitimation of the processing of your personal data
The legal basis that legitimises us to process personal data is the express consent granted by the User. BENETAN will always communicate in a clear and simple manner the purpose of the processing, which is the object of the express consent; if express consent is not forthcoming, BENETAN will not be able to provide the requested service.

Recipient of your personal data
BENETAN, unless expressly required by law, has no intention of transferring the User’s personal data to third parties. In the event that a transfer of this type is to be made, express prior consent will be requested, and the User will be informed of the recipients of the transfer or of the category of recipients if they are not clearly predetermined.

BENETAN may contract the services of third parties that involve access to personal data on behalf of a third party but always within the scope of the provision of a service which gives rise to a processing order under the conditions set out in Articles 28 and 29 of the aforementioned European Regulation. In these cases, BENETAN will regulate the processing order through the corresponding confidentiality contract, which will clearly reflect the commitments that both parties acquire in the processing of your personal data with regard to their confidentiality and security.

In the event that the data processor is an entity outside the European area, it will work with entities that, in the opinion of the Spanish Data Protection Agency, have a comparable level of security, demonstrable through the following channels:

The company providing the service is on the list of countries with a level of protection comparable to that of the European Union
The international transfer of personal data is expressly authorised by the Spanish Data Protection Agency
The service provider works under the EU-US Privacy Shield agreement

Rights related to the processing of your personal data
The User, as the holder of personal data processed by BENETAN, and under Articles 15 to 21 of the aforementioned European Regulation, may exercise, at any time, the rights of access, rectification or deletion, limitation to processing, opposition and/or portability. In order to do this, please contact BENETAN through any of the usual communication channels, and specifically through the contact details laid out in point 1 of this Privacy Policy, requesting the desired right. To do this, you must first identify yourself unequivocally, ensuring that you are the owner of the personal data over which you wish to exercise the right. BENETAN will carry out the modifications as soon as possible and, in any case, without undue delay. Should the User have any doubts regarding his/her rights and how to exercise them, BENETAN is at his/her disposal to provide all the necessary information and carry out any actions required.

In the event that the User considers that the request to exercise his/her rights has not been adequately addressed, he/she may file a complaint with the competent Control Authority; for this purpose, we provide the main contact details of the Spanish Data Protection Agency.

Source of data
The source of the User’s personal data processed by BENETAN will be the owner of the same or his/her legal representative, or the person or persons expressly authorised by the owner. The categories of data processed will always correspond to data of an identification, financial, commercial, academic and/or professional nature, and in general, any type of personal data that is not considered to be specially protected data.
